Federal Constitution of the Federation of Vuhifellian States
November 1, 2073


PREAMBLE

Recognizing the fact that the several previous forms of continental government have failed, we, the Congress of the Democratic Republic of Vuhifell, hereby disband the existing government, in order to create and promote peace and order between the states. This new constitution, shall be emblazened with the pulse that it shall be stronger and more united than any previous form of continental government, and that its citizens shall have the guarantee of security, peace, and liberty.

Article I - Governance

Section I - Legislation

The legislative branch of this government shall include the Federational Congress, which shall be divided into two divisions. The upper division, known as the Congressional Delegation, and the lower division, the Senate. All legislation can either be proposed in both divisions, however, it may only be voted upon, if approved by the Senate. For legislation to become law, there must be a sixty-five percent majority in the Senate, and a simple majority in the Congressional Delegation.

Section II - Congressional Delegation

The Congressional Delegation shall be directly elected by the people of their respective provinces. The apportioned number of Delegates:Citizens shall be 1:10,000,000. Any provinces with a population lower than ten-million persons shall not be represented in the Congressional Delegation. Each delegate shall recieve one vote, which may be directed towards a yea, nay, or abstentions. The Congressional Delegation shall be led by the Supreme Delegate, who shall recieve the power to veto any legislation in the Congressional Delegation. A simple majority is needed to override the veto.

Subsection I - Duties of the Congressional Delegation

The Congressional Delegation shall have the responsibilities and duties to: publish reports on the Federal government, set up queries into risky ventures, control funding for the different councils, approve referendums, approve taxes, and submit Federal Warrants for government officials. No government official shall be arrested within the borders of Vuhifell without a Federal Warrant being submitted by the Congressional Delegation.

Section III - Senate

The Senate shall be directly elected by the people of their respective provinces. There shall be a fixed number of three Senators per province. All provinces shall be represented. Each Senator shall recieve one vote, which may be directed towards a yea, nay, or abstentions. The Senate shall be led by the Supreme Senator, who shall recieve the power to veto any legislation in the Senate. A sixty-five percent majority is needed to override the veto.


Subsection II - Duties of the Senate

The Senate shall have the responsibilities and duties to: write and edit reports on the Federal government, approve queries into risky ventures, submit requests for referendums, submit tax proposals, and approve Federal Warrants for government officials.

Section IV - High Court

The High Court shall consist of one High Judge for every province in the Federation, and one Supreme Judge for the nation (two Supreme Judges may be elected in war-time). High Judges may only be elected by the legislatures of their respective provinces, and only after the Administrator of that province nominates them for election. The Supreme Judge of the High Court may only be elected by the Federational Congress, and only after the President has nominated them for the election. A High Judges vote shall count once on the High Court, and may be directed towards a yea or nay. A Supreme Judges vote counts once on the High Court, and may be directed towards a yea, nay, or absention.

The High Court shall hear all cases involving provinces, government officials, and all cases not resolved by lower courts. The High Court (along with the Supreme Council and President) may declare diplomatic immunity null and void. The High Court is also the only institution in the Federation which may approve a request by the Military Council to initiate Martial Law.

A simple majority is needed to enact all actions by the High Court.

Section V - Presidency

The President of the Vuhifellian Federation shall be directly elected by the people. A simple majority of votes in needed in each province to gain a Presidential candidate more election points. Higher ranked provinces gain more election points for a candidate than lower ranked provinces. More important provinces, such as those of high economic and military importance, are ranked high.

The President's duties are as follows: The President shall be the Supreme Commander-in-Chief of all Vuhifellian armed forces, his decision overrides the decision of the Military Council, and Council of War. The President may veto Congressional legislation, if a Presidential veto is used, a 70 percent majority from both divisions is needed to override the veto. Presidential approval is needed on all legislation and government documents (if the President is unable or unwilling to approve the documents, the Supreme Council and the Vice-President may approve them for the President).

Article II - Federal Law

Section I - Supercession and Definition

Federal Law shall be defined as laws that have been voted upon, and approved, by the Federational Congress. Federal Law may in no way interfere with Constitutitonal Law, and the two are wholly different. This Constitution, and its subsequent additions, shall override all existing laws. No laws may contradict Constitutional Law, and it may only be refined and repealed through a Federal Law Review. Federal Law is beneath Constitutional Law, and it overrides Provincial Laws, no Provincial Laws may interfere or contradict Federal Law, finally, no Municipal Laws may contradict or interfere with Provincial Law, which is above Municipal Law.


Section II - Federal Law Review

If a petition of at least 100,000,000 citizens signatures is presented to the High Court, it may then hold a Federal Law Review; allowing the Federal government, Provincial governments, city governments, and all citizens of the Federation, to discuss new and old laws, this is also the only way to legally edit the Federal Constitution. Once Constitutional edits are agreed upon, each edit is presented in a referendum to the populace, where a 70 percent majority is needed to pass each edit.


Article III - Additions

Section I - This Constitution has been edited during the ratification process without a convened Federal Law Convention. There are fifteen original edits (Articles IV-XVIII), which may not be repealed or edited, even through other edits or Federal Law Conventions. Further edits may be applied, and are allowed to be repealed and edited via Federal Law Review.
