The Constitution of the Neo-Prussian Parliamentary Dictatorship of Kampfers

Preamble


In order to better establish justice, uphold freedom, provide for the national defense, and protect the rights of the common man, we hereby declare this Constitution for the Neo-Prussian Parliamentary Dictatorship of Kampfers. Let the contents of this document reflect the policies of the government, and let the articles contained herin never infringe upon the rights of the common man.


Article I


Section I

All legislative Powers herein granted shall be vested in a Parliament of Kampfers, which shall be a unicameral system consisting of the House of Lords.

Section II

The House of Lords shall be composed of Members chosen every sixth year by the People of the several Provinces, and the Electors in each State shall have the Qualifications requisite for Electors of the most numerous Branch of the State Legislature.

No Person shall be a Representative unto the House of Lords who shall not have attained to the Age of twenty Years, and been born a Male, and been fifteen Years a Citizen of Kampfers, and who shall not, when elected, be an Inhabitant of that Province in which he shall be chosen.

Each Province shall elect two Representatives unto the House of Lords, such that Representation might be equal for all.

When vacancies happen in the Representation from any Province, the Fuhrer of Kampfers thereof shall issue Absentee Writs to fill such Vacancies.

The House of Lords shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment. Should the Lord of Parliament be unavailable, the Arch-Chancellor shall preside over the House of Lords. The Arch-Chancellor will is granted the Right of Visitation for all House of Lords Sessions, and this Right shall not be Revoked at any time.

The House of Lords shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the Fuhrer of Kampfers is tried, the Lord of Parliament shall preside: And no Person shall be convicted without the Concurrence of a majority of the Members present. Should the Ballots end in a deadlock, the Arch-Chancellor will cast his Ballot to determine the Election. In all other Cases, the Arch-Chancellor shall not vote.

Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under Kampfers: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

Section III

The Times, Places and Manner of holding Elections for Representatives unto the House of Lords, shall be prescribed in each Province by the Legislature thereof; but the House of Lords may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators. The House of Lords may not Revoke the Right of the People to chuse their Representatives.

The Parliament shall assemble at least twice in every Year, and such Meeting shall be on the first Monday in June and December, unless they shall by Law appoint a different Day. The Fuhrer of Kampfers retains the Right to demand a Special Session of Parliament at any time.

Section IV

The Parliament shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business; but a smaller Number may adjourn from day to day, and may be authorized to compel the Attendance of absent Members, in such Manner, and under such Penalties as each House may provide.

The Parliament may determine the Rules of its Proceedings, punish its Members for disorderly Behaviour, and, with the Concurrence of two thirds, expel a Member.

The House of Lords shall keep a Journal of its Proceedings, and from time to time publish the same, excepting such Parts as may in their Judgment require Secrecy; and the Yeas and Nays of the Members of either House on any question shall, at the Desire of one fifth of those Present, be entered on the Journal.

Section V

The Representatives unto the House of Lords shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of Kampfers. They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of Parliament, and in going to and returning from the same; and for any Speech or Debate in Parliament, they shall not be questioned in any other Place.

No Representative unto the House of Lords shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States, which shall have been created, or the Emoluments whereof shall have been encreased during such time; and no Person holding any Office under the United States, shall be a Member of Parliament during his Continuance in Office.

Section VI

The Parliament shall have Power To lay and collect Duties, Imposts and Excises, and to pay the Debts; but all Duties, Imposts and Excises shall be uniform throughout the United States;

To borrow Money on the credit of Kampfers;

To regulate Commerce with foreign Nations, and among the several Provinces;

To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout Kampfers;

To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;

To provide for the Punishment of counterfeiting the Securities and current Coin or Bill of Kampfers;

To establish Post Offices and post Roads;

To promote the Progress of Science, by securing for limited Times to Inventors the exclusive Right to their respective Discoveries;

To define and punish Piracies and Felonies committed on the high Seas, and Offences against the Law of Nations;

To fully Mobilise the Army, however, not declare war;--And

To grant Letters of Marque and Reprisal;

Section VII

The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.

No Bill of Attainder or ex post facto Law shall be passed.

No Capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or enumeration herein before directed to be taken.

No Tax or Duty shall be laid on Articles exported from any Province.

No Preference shall be given by any Regulation of Commerce or Revenue to the Ports of one Province over those of another; nor shall Vessels bound to, or from, one Province, be obliged to enter, clear, or pay Duties in another.

No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.

No Title of Nobility shall be granted by Kampfers: But any Person holding any Office of Profit or Trust under them, shall accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.

Section VIII

No Province shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.

No Province shall, without the Consent of the Parliament, lay any Imposts or Duties on Imports or Exports, except what may be absolutely necessary for executing it's inspection Laws: and the net Produce of all Duties and Imposts, laid by any Province on Imports or Exports, shall be for the Use of the Treasury of Kampfers; and all such Laws shall be subject to the Revision and Controul of the Parliament.

No Province shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, Planes of War, or Ships of War in time of Peace, enter into any Agreement or Compact with another Province, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.


Article II


Section I

The executive Power shall be vested in a Fuhrer of the Neo-Prussian Parliamentary Dictatorship of Kampfers. He shall hold his Office for life.

No Person except a direct male descendant of the previous Fuhrer shall be eligible to the Office of the Fuhrer; except in the case that the Fuhrer leaves behind no male heirs, in which case the closest male relative would take possesion of the office. The Fuhrer will designate which of his sons becomes the next Fuhrer. In the case that the Fuhrer passes before such documentation can be acquired, then the eldest son will assume his place.

The Fuhrer shall, at stated Times, receive for his Services, a Compensation, which may only be be increased or diminished during the Period for which he is in office by the Parliament, and he shall not receive within that Period any other Emolument from the United States, or any of them.

Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:--"I do solemnly swear (or affirm) that I will faithfully execute the Office of Fuhrer of Kampfers, and will to the best of my Ability, preserve, protect and defend Kampfers where she is."

Section II

The Fuhrer shall ordain an Arch-Chancellor who will hold Power while the Fuhrer is away. The Arch-Chancellor must be at least twety five years of age and have been a citizen of Kampfers for twenty years. No person except a natural born citizen may be eligible to this Office.

Section III

The Fuhrer shall be Commander in Chief of the Army, Navy, and Air Force of Kampfers, and of the Militia of the several States, when called into the actual Service of Kampfers; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment. He has teh sole power to raise a military, but may not fully mobilise it without the Consent of Parliament.

He shall have Power to make Treaties; and he shall appoint Ambassadors, other public Ministers and Consuls, Judges of the Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

The Fuhrer shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

He shall have the Power to make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of Kampfers, or in any Department or Officer thereof.

Article IV

The Fuhrer, Arch-Chancellor, and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.
