Equilism Constitution


Endorsement Swapping Law (25 November 2004)

1. In order to maintain the security of region and the UN Delegacy, The Commonwealth of Equilism hereby establishes an endorsement limit of 15 endorsements, for any UN nation, other than the duly elected Delegate.

2. Any nation that exceeds the Endorsement Limit shall be advised by telegram an/or pm that the limit has been exceeded, and that it is requested that they come into compliance.

a. Compliance may be acheived by requesting and obtaining unendorsements, or by leaving the region until the next update occurs, then returning to the region.
b. Nations that have been advised of their overlimit status shall have 72 hours to come into compliance. If the overlimit status remains after 72-hours, The Founder shall eject, and temporarily ban the nation until the next update has passed.
c. Nations may appeal to the The Founder for additional time if they are actively attempting to have their nation unendorsed, and can show good cause. Extensions are at the sole discression of The Founder.
d. Nations that continue to actively swap endorsements after notice has been sent to them, may be ejected from the region at any time by The Founder.

4. If any nation reaches the endorsement limit three (3) times; The Founder may impose a permanent ban.

5. Any nation that is known or becomes known to be an invader of Equilism that is swapping endorsements in the region, shall be subject to immediate ejection and banning. Such action is not subject to appeal.

6. Any conspiracy to engage in endorsement swapping for the purpose of gaining the Delegacy illegally, shall be considered an invasion, and immediate ejection and banning shall result for all nations involved. Such conspiratorial actions may be subject to review of Bureau 13, and hearing before the Imperial Inquisitor.

7. This law may be subject to review and revision by The College at any time.

Honours and Decorations

I. Military Honours and Decorations

Decorations shall be awarded for long service or particular merit in battle. All recipients are entitled to use appropriate post-nominal initials, and/or graphic medalions when designed. Decorations are made by consultation between Commanders.

  1. For Bravery
    • Equilism Cross (EC) – For outstanding use of initiative, courage and leadership in battle.
    • Equilism Military Medal (EMM) – For particular bravery or notable service in battle.
  2. For Long Service
    • Distinguished Service Order (DSO) – For minimum of four months of dedicated service.
    • Distinguished Service Medal (DSM) – For minimum of two months of dedicated service.

II. Civilian Honours and Decorations

Decorations shall be awarded for exemplary service to the Region. All recipients are entitled to use appropriate post-nominal initials, and/or graphic medalions when designed. Decorations are made as defined below.

  1. Equilism Meritorious Service Award (EMSA) - For Exemplary service to a particular Ministry. This Honour is given by each respective Minister, and will be presented with the designation of that particular Ministry. (i.e. Equilism Meritorious Foreign Service Award).
  2. Equilism Medal of Honour (EMH) - For Exemplary and Commendable Service to the region, our highest honour. This honour is given by the Equilism Council to any region member that has contributed greatly to Equilism.


Role Playing Currency (25 November 2004)

Introduction:
1. Seeing the discouragement of trade caused by having to get your money exchanged,
2. And noticing the trade boom in the RL Europe after the adoption of the Euro,
3. And realizing the benefits possible in Equilism with the creation of a uniform currency,

The Realm of Equilism hereby establishes and adopts a role playing currency called the Equiliant.

I. Changing your nation currency field to Equiliant will be encouraged.

II. The exchange rate for the Equiliant will be set to 1:1 with the US Dollar.

III. The symbol for the Equiliant will be eq2.gif

IV. The Equiliant is divided in 100 cents and has 7 coin denominations and 8 banknote denominations.

1. Coin denominations are: 2 Equiliant, 1 Equiliant, 50 cents, 25 cent, 10 cent, 5 cent, 1 cent
2. Banknote denominations are: 5, 10, 25, 50, 100, 250, 500 and 1000 Equiliants


Judicial Code (29 November 2004)

Definitions (not outlined in the Constitution)

  • Prosecutor: Typically voluntary but can be appointed by the Chief Justice. This nation will compile evidence against the accused and present evidence at the appropriate time.
  • Defendant: Typically the accused nation. However, the accused can seek a nation WITHIN Equilism to act as their Defender as long as the selected nation is not a member of the Judicial Branch.

The decision making procedure

The Justices will discuss the case after all evidence that has been presented by both parties. Each Judge will have one vote on whether the accused is guilty or not guily.

Verdict

In the event of a not guilty verdict the Chief Justice will announce said verdict on a public board of Equilism.

In the event of a guilty verdict, the Chief Justice will announce said verdict on a public board of Equilism. Punishment will be decided by the Justices, and carried out by the Executive branch after a full meeting of both Branches.

The Chief Justice will announce the agreed upon punishment on a public board of Equilism prior to carrying out said punishment.

Criminal Offences in Equilism

These laws are hereby declared in the interests of maintaining the order of the inter-regional sovereignty of Equilism and of protecting the rights of its member nations.

From now on, the following attempts at these acts, successful or unsuccessful, shall be prosecutable offences in the region of Equilism, which shall demand punishment as determined by the Supreme Court:

Treason: No nation shall work intentionally to the detriment of Equilism or Allied regions or organizations, to directly or indirectly attack or weaken the region or its allies. This is capital offense.

Insurrection: No nation shall intentionally attempt to overthrow, violate or ignore the authority of the reigning government established by the Constitution of Equilism or undermine any rule of the Constitution itself. This is a capital offense.

Espionage: No nation shall attempt to to collect and/or disclose sensitive information to nations that are not specifically privy to that information or somehow purposely aid in such an inappropriate transfer of information. Nations are also not allowed to attempt to collect information that they are not privy to know themselves. These are capital offences.

Military Aggression: No nation shall engage in military action unsanctioned by the government of Equilism against anyone, anywhere and at any time. This is a capital offence.

Coercion: No nation shall attempt to force other member states to act against their will by threats of violence, humiliation or the deprivation of rights and services typically enjoyed by members of Nation States.

Perjury: No nations shall lie while testifying before a court of law or any government branch.

Conspiracy: No nations shall conspire with others to achieve the offences listed here.

Concealment: No nation shall attempt to conceal the perpetration of the offences listed here, including this one.

Furthermore, all actions not listed here, but listed as prohibited in any other official government document are to be taken as criminal offences.


Dual Citizenship Requirements (26 April 20050

The Senate of Equilism;

Having received two requests for Dual Citizenship in the past two weeks;

Observing that nations may not realize they are required to seek a dual citizenship;

Deeply concerned that applications are not being subjected to the same standards and scrutiny;

Taking into account concerns expressed by several nations over the fairness of the review process;

  1. Confirms the desires of nations in this region to keep Equilism as open and fair as possible;
  2. Calls for the following to be made the default application for dual citizenship:
    • In what other region(s) do you hold citizenship?
    • What is your UN nation, and where does it reside?
    • If your UN nation is not in Equilism, do you have any plans to either move it here or switch UNs so that it is? If not, why not?
    • What governmental positions do you currently hold in any region, or have you held previously?
    • Have any regions you are currently associated with ever invaded any other region when not in an officially recognised, justly sanctioned declaration of war? If yes, what region(s) and what reason(s)?
    • Do any regions you are currently associated with have plans to invade another region for any reason other than an officially recognised, justly sanctioned declaration of war? If yes, what region(s) and what reason(s)?
    • Are any regions you are currently associated with at war with any other region(s)? If yes, which one(s)?
    • Are any regions you are currently associated with have any ties of any kind to any current or future invader organisations? If yes, what and why?
    • Do you promise to abide by all the rules of Equilism?
    • Do you fully understand the consequences of not abiding by the stated rules?
    • Why do you feel the need to apply for a dual citizenship?
  3. Emphasizes that any individual case is subject to review and applicants may be further questioned by anyone who feels the need;
  4. Reccomends to the council to implement a system wherein if there are any doubts about an individual application it be put to a vote by the council to decide whether or not he or she is to be accepted, based upon majority vote;
  5. Mandates that answers to the questions in section 2 be posted as a formal application in the Public Council Chamber so that all members of Equilism may see them and ask further questions of the applicant for a period of three days. The applicant is expected to answer all questions as fully and in as timely a manner as possible;
  6. Proposes a standard objection form, to read I, (insert name here), must raise a formal objection against (insert name here)'s application for the following reasons. (Insert reasons here.) I respectfully ask that a vote be held by the Council of Equilism to decide on this applicant's application. and to be placed in the application thread by the objecting member;
  7. Emphasizes that more than one objection can be placed;
  8. Creates for the Chief Executives a veto power to be used against an applicant, which must be seconded by the Intelligence Minister to pass, to be used in cases of regional security. This cannot be overridden by the council unless coercion or trickery is proven;
  9. Proposes this oath to be taken before citizenship is official, but after questioning/voting is over:
    • I, (insert Nation name here), do swear to uphold the laws and treaties of Equilism, to serve however I am able, to inform its government of threats pertaining to it, and to honourably and faithfully defend it, both from invasions and slander
  10. Reminds applicants that UN membership is not required, but access and ability to serve in an official capacity are severely limited if UN status is not activated on your nation in Equilism.


Internal Ministry Reform Act (30 April 2005)

The Constitution of Equilism states:

5. The Internal Affairs Department The Internal Affairs Department, to be headed by the Minister, will be responsible for keeping up to date with the happenings in the region, communicate with (new) members and provide information to regional members. This Department shall also initiate and oversee activities for the general entertainment of the Equilism member nations.

I propose that some adjustment be made to the duties and responsibilities of the interior department. The propose adjustments could help alleviate the workload of other ministries and will also increase the involvement of the interior department in the region for the benefit of the region.

I. Entertainment

  • Appointment of a person(s) from within the citizenry to keep record of quizzes and games and provide a timely report to the minister for update of the score list.
  • This person(s) will also seek to find new games, debate topics and role play activities.

II. The News Agency

  • The Equilism News Agency will be responsible for keeping the region up to date on regional events. This will include news on games, debates, members’ birthdays, and senate happenings.
  • The News Agency will be responsible for making a weekly report on interior happenings. Also the agency will come up with daily short reports to post on RHQ that could possibly attract new members.
  • The Agency will also be responsible of keeping the region up to date on NS happenings by doing short articles on anything important that happens in NS and conducting interviews with important players both within and outside the region.
  • Will keep the regions portal site up to date with the most recent news in the region.
  • The News Agency will consist of:
    • Editor in Chief: The editor in chief will be chosen by the minister. The duties of the Editor are to select reporters from those who volunteer. Also the Editor will have the discretion of choosing what stories to cover and who to interview. Doubtful or sensitive topics should have the minister’s approval before going forward with them. Also, the editor will submit the news stories to the minister for posting on the regional portal.
    • Reporters: Must have consent of the editor to write for the agency. Reporters will take on stories and interviews assigned by the Editor.
    • Both reporters and the editor are under the jurisdiction of the Interior Minister and all stories require final approval by the ministry. The Minister my choose to participate actively in the writing process if he or she so wishes.

III. Citizenship

  • The interior department will take charge of dual citizenship requests. The requests will be submitted to the minister or proper appointed official in accordance to the Dual Citizen Requirement Law for review to make sure that the applicant meets all the requirements.
  • The minister will forward to the intelligence department any questionable application for review.
  • Once the applicant has passed the screening, the minister will open the proper threads both for questioning by the council and for a vote on granting of citizenship.

IV. Voting

  • The interior minister and those appointed by him will make sure that any election bids for senate meet the requirements set by the council and that if they do a voting thread be open in a timely matter.
  • The interior minister and those appointed by him will also make sure that the elections for the new term begin in a timely matter and that a thread is open for all those running for senator, Prime Minister and President. Also, the ministry will make sure that a debate thread be open and that debate be held in a timely and respectful manner.
  • The ministry will make sure that any new alliances or external affairs matter that need to be voted on be made public to the citizenry before any voting is open so that they may be able to be familiar with the situation. Once this is the done a thread will be open on the topic.
