The Federated Stars Criminal Code

Notes

  • No Bail = ^
  • In certain cases, Revoking of Citizenship and/or exile, or public working may be used as an alternative sentence or after the sentence.
  • For nobles, any Never To Be Released with hard labour sentence, will instead be giving the death penalty. A noble will be beheaded by a sword in the city's central public square, for the most heinous of crimes, it's possible for a male noble to be drawn and quartered, it has only happened once in the history of The Federated Stars. A women noble found guilty can only be beheaded, and that has yet to ever happened.
  • Military personal are ether executed by a firing squad or, if in the Stellar Navy, by spacing.

Section 1 - Homicide

  • Grade 1 : Murder 1st Degree - Never To Be Released with hard labour ^
  • Grade 2 : Murder 2nd Degree - Never To Be Released with hard labour ^
  • Grade 3 : Attempted Murder - Never To Be Released with hard labour ^
  • Grade 4 : Manslaughter (Incidental or accidental murder) while in the act of committing other crimes. Criminal or contributory negligence resulting in the death of a second party - 40/Never To Be Released with hard labour ^
  • Grade 5 : Murder of a Law Enforcement Animal - 30/Never To Be Released with hard labour ^
  • Grade 6 : Attempted Murder of a Law Enforcement Animal - 20/Never To Be Released with hard labour ^

Section 2 - Assault

  • Section 2-A - Assault
    • Grade 1 : Torture - Never To Be Released with hard labour ^
    • Grade 2 : Assault Causing Grave Bodily Harm - 20/40 years with labour ^
    • Grade 3 : Assault with Weapon - 10/20 years with labour ^
    • Grade 7 : Assault of a Law Enforcement Dog - Fines & Community service after 1/5 years with labour
    • Grade 4 : Endangerment, by negligence, behaviour or deliberate act - Fines & Community service after 1/10years with labour

  • Grade 3 : Unlawful Confinement - 20/40 years with labour ^
  • Grade 4 : Coercion by force - Fine & 8/15years ^


Section 4 - Burglary

  • Grade 1 : Burglary, including forced entry - 5/10 years with labour
  • Grade 2 : Possession of burglar's tools - 3 months / 5 years
  • Grade 3 : Trespass - Fines & 1month/5years


Section 5 - Robbery

  • Grade 1 : Armed Robbery with Violence - 20/30years ^
  • Grade 2 : Armed robbery - 10/20years ^
  • Grade 3 : Piracy - 30/60 years with labour ^
  • Grade 4 : Grand Theft Auto Causing Death - see S1 G4 Manslaughter ^

  • Grade 8 : Embezzlement - Fine and 5/8 years with labour
  • Grade 9 : Shop lifting and other petty thefts - Fines & Community service (must work for the store with an "I am a Theft" sign) for 2months for free / 1month to 1year with labour (upped 1 month with each convection)

Section 6 - Weapons Offences

  • Grade 1 : Unlawful Firearms Possession - 1,000,000 ¥/2years with labour
  • Grade 2 : Weapons Trafficking - 7/17years with labour ^


Section 7 - Theft Related Offences

  • Grade 1 : Passing, receiving and/or dealing and trading in stolen goods - 6/10years
  • Grade 2 : Misuse of private property for storing illicit material - 3/5years
  • Grade 3 : Possession of know stolen property - 1/5years
  • Grade 4 : Minor theft; fare dodging, illicit money, ect. - Fines & 1/6months


Section 8 - Forgery

  • Grade 1 : Forgery - Fines & 8/15years
  • Grade 2 : Possession of forging equipment - Fines & 5/12years
  • Grade 3 : Possession of know forged items - Fines & 2/8years


Section 9 - Arson

  • Grade 1 : Arson - Heavy fines & 10/20 years with labour ^
  • Grade 2 : Endangerment or criminal negligence, resulting in fire - Fines & 5/10years ^


Section 10 - Criminal Damage

  • Grade 1 : Criminal Damage - Fines & 2/6years


Section 11 - Public Order

  • Grade 1 : Gangsterism - 8/15 years with labour ^
  • Grade 2 : Rioting - Fines & 2/10years
  • Grade 3 : Unlawful assembly - Fines & 2/5years
  • Grade 4 : Disorderly conduct - Fines & 1/5years
  • Grade 5 : Vandalism - Fine and Community service/1 year with labour
  • Grade 6 : Hate Crime - Fines & 5/20 years with labour


Section 12 - Public Nuisance

  • Grade 1 : Breach of Peace, Health or Fire Regulations - Fines & 10 day/5years
  • Grade 2 : Jaywalking - Fines (unenforced excepted when life is endangered)
  • Grade 3 : Littering in public - Heavy Fines & 1 to 200 Days
  • Grade 4 : Unlawful Building Renovation - Heavy Fines & 3-6 years with labour
  • Grade 5 : Unlawful Building Construction - Heavy Fines & 2-5 years with labour


Section 13 - Arrest Offences

  • Grade 1 : Abetting an criminal - 10/25years
  • Grade 2 : Resisting arrest - 1/5years
  • Grade 3 : Leaving the scene of a crime. Obstructing an officer in the cource of his duty. Running from police. - 6months/5years
  • Grade 4 : Threatening language, disrespectful behaviour, ect to a officer - Fines & 10days/1month
  • Grade 5 : Inhumane Animal Cruelty - 8/15years
  • Grade 6 : Animal Cruelty - 1/5years


Section 14 - Perverting the Course of Justice

  • Grade 1 : Perverting the Course of Justice - 10years/Life
  • Grade 2 : Bribery - 10years
  • Grade 3 : Bribery of a civilian - 2/10years
  • Grade 4 : Perjury - 1/5years


Section 15 - Impersonation

  • Grade 1 : Impersonation with intention to commit a crime - 10years
  • Grade 2 : Impersonation for reasons other than crime. Defamation of image - 1/5years
  • Grade 3 : Impersonation for gain or otherwise - 6months/2years


Section 16 - Security Offences

  • Grade 1 : High Treason - Never To Be Released with hard labour ^
  • Grade 2 : Treason, passing classified information to an enemy power - 50 years/Never To Be Released with hard labour ^
  • Grade 3 : Attempting to gain access to classified information for treasonable purposes or otherwise - 50 years with labour ^

Section 18 - Controlled Substances

  • Grade 1 : Drugs, Trafficking - 5/12 years with labour ^
  • Grade 2 : Drugs, Possession - Fine ,Community service 2/5 years prison detox if needed
  • Grade 3 : Manufacturing or smuggling proscribed item into The Federated Stars - 10/25years ^
  • Grade 4 : Trading in proscribed item - 5/18years
  • Grade 5 : Possession of proscribed item, for purposes other than above - 6months/10years


Section 19 - Gambling Offences

  • Grade 1 : Organising illegal gambling event with intent to gamble - 5/15years


Section 20 - Traffic Offences

  • Grade 1 : Driving under the influence of drugs or drink - Vehicle Forfeited & Sold, Community service, provincial punishments, ¥100,000 - ¥20,000,000 fine, installation of a Ignition interlock device for a period of 1 to 20 years after the driving prohibition,

1st offence - 1year Driving Disqualification, 2nd offence - 3year Driving Disqualification & 1month/6months 3rd offence - Life Driving Disqualification & 6months/2year ^ V

  • Grade 2 : Speeding - Loss of vehicle for 1to3 months and ¥20,000 - ¥10,000,000 fine, Community service,

1st offence - 2week Driving Disqualification, 2nd offence - 2months Driving Disqualification, 3rd offence - 6months max in jail & Life Driving Disqualification ^

  • Grade 3 : Dangerous driving - ¥50,000 - ¥1,000,000 fine, 6months/2year ^
  • Grade 4 : Driving with undo Care and attention - ¥50,000 - ¥1,000,000 fine/20days
  • Grade 5 : Failing to stop after an accident or failing to report an accident - ¥100,000 - ¥1,000,000 fine & 10days/6 months
  • Grade 6 : Driving when disqualified - ¥100,000 - ¥1,000,000 fine & 20days/6 months
  • Grade 7 : Driving without insurance - ¥50,000 - ¥1,000,000 fine
  • Grade 8 : Driving an Unroadworthy Vehicle - ¥100,000 - ¥1,000,000 fine/3months
  • Grade 9 : Light-jumping, erratic driving, slow driving, Seat belt offences, meter or parking violation - ¥50,000 - ¥1,000,000 fines/1month


Section 34-37 Self-defence

Criminal Code CC-S34-37 - The Self-defence Law While the general rule makes an important distinction between the use of physical force and deadly physical force. A person may use physical force to prevent imminent physical injury, however a person may not use deadly physical force unless that person is in reasonable fear of serious physical injury or death to themself or another. Also included a duty to retreat, wherein deadly physical force may only be used if the person acting in self-defence is unable to safely retreat. As discussed above, a person is generally not obligated to retreat if in one's own home (for example, a person doesn't have to retreat from the living room to the kitchen, then to the bedroom, then to the bathroom). "An one in violation of this law will be charged with Murder"

Sections 34

  • 34 - Every one who is unlawfully assaulted without having provoked the assault is justified in repelling force by force if the force he uses is not intended to cause death or grievous bodily harm and is no more than is necessary to enable him to defend himself.
  • 34-B - Every one who is unlawfully assaulted and who causes death or grievous bodily harm in repelling the assault is justified if
  • 34-C - He causes it under reasonable apprehension of death or grievous bodily harm from the violence with which the assault was originally made or with which the assailant pursues his purposes; and
  • 34-D - He believes, on reasonable grounds, that he cannot otherwise preserve himself from death or grievous bodily harm.

Section 35

  • 35 - Every one who has without justification assaulted another but did not commence the assault with intent to cause death or grievous bodily harm, or has without justification provoked an assault on himself by another, may justify the use of force subsequent to the assault if
  • 35-A - The uses of force
  • 35-A-1 - Under reasonable apprehension of death or grievous bodily harm from the violence of the person whom he has assaulted or provoked, and
  • 35-A-2 - In the belief, on reasonable grounds, that it is necessary in order to preserve himself from death or grievous bodily harm;

35-B - He did not, at any time before the necessity of preserving himself from death or grievous bodily harm arose, endeavour to cause death or grievous bodily harm; and 35-C - He declined further conflict and quitted or retreated from it as far as it was feasible to do so before the necessity of preserving himself from death or grievous bodily harm arose.

Section 36-37

  • 36 - Provocation includes, for the purposes of sections 34 and 35, provocation by blows, words or gestures.
  • 37-A - Every one is justified in using force to defend himself or any one under his protection from assault, if he uses no more force than is necessary to prevent the assault or the repetition of it.
  • 37-B - Nothing in this section shall be deemed to justify the wilful infliction of any hurt or mischief that is excessive, having regard to the nature of the assault that the force used was intended to prevent.
