CONSTITUTION OF ZURICH

We the People, in order to form a more perfect region, establish justice, insure domestic tranquility, provide for the common defense, and secure the blessings of liberty, to ourselves and posterity, do ordain and establish this Constitution for Zurich.

ARTICLE I – ELECTIONS

1. All nations residing in Zurich three days prior to the voting period will be entitled to vote regardless of UN status. Excluded from voting are those nations that openly represent foreign regions or interests.

2. Elections are to be held every three calendar months and candidates' campaigns may start one week before the voting period. Potential candidates must announce their intention to run for an specific government position at least three days before the voting period begins. The length of the voting period has to be established at least three days before the voting process starts. Voting more than once is prohibited, regardless of whether or not the person has multiple nations.

3. Regional elections have no effect on the selection of Zurich's UN Delegate. The current UN Delegate is not entitled to run for another government post. The delegacy will solely depend on the amount of endorsements that a particular nation amasses, and thus is unaffected by popular elections. In the event of an election tie, the current UN Delegate has the tiebreaker vote. The UN Delegate is otherwise not entitled to vote in an election.

4. Government officials may be re-elected for the same position consecutively only once. If the government official wins and serves two full terms, he/she must wait at least one full term to run for that same position again. However, the official may run for a different government position after serving two terms in the current post.

ARTICLE II – GOVERNMENT POSITIONS

1. The following positions shall make up the government of Zurich:

a) President The President shall be in charge of communicating with all member nations of Zurich. The President shall inform member nations of events of significance including but not limited to military recruiting, updates on foreign intelligence, current UN ranking lists, etc. The President shall seek and gauge regional opinion on issues of importance based on both formal and informal polling methods, as well as coordinating actions between all governmental positions.

b ) Secretary of Defense (equivalent to current Secretary of War) The Secretary of Defense shall be responsible for all the operations of Zurich's Armed Forces, whether they be in defense of Zurich, or during the occupation of enemy regions. The Secretary of Defense is responsible for amassing all military and foreign intelligence. This government official shall also start military action whenever an emergency, defense situation arises. In the case of a foreign invasion, it may only be carried out upon approval by the majority of governmental positions.

c) Chief of Justice (equivalent to Secretary of Homeland Security) The Chief of Justice shall be responsible for amassing domestic intelligence and maintaining order within the region and may act as a mediator between conflicting nations. The Chief of Justice is also responsible for organizing the details of elections such as the region’s election schedule and organization. The COJ shall draft laws at the request of the President and/or draft UN resolutions at the request of the UN Delegate. However, every drafted law must be approved by all governmental positions to become effective.

d) Secretary of State The Secretary of State is directly responsible for the recruitment of new nations to join the region of Zurich. It is also in charge with maintaining newly approved (by government majority) diplomatic ties with foreign regions and suggesting new alliances. This position also plans for Zurich's future expansion, drafting welcome notes and encouraging current nations to participate more actively in the region through constant communication with the Zurich people. The Secretary of State may also help the Secretary of Defense with foreign intelligence, and may work with Zurich's UN Delegate in matters that affect foreign relationships or interests.

e) UN Delegate The UN Delegate shall not be elected by popular vote but through the mechanisms already in place at nationstates.net : The nation with the most endorsements is the effective UN Delegate and thus, is not a position affected by elections. This position requires giving all UN nations in Zurich a reasonable opportunity to express their individual viewpoints on pending UN resolutions before voting in the United Nations; and actively promoting debate on current and/or future UN issues.

2. Any time a government official fails to hold office and the position becomes vacant, a vote of confidence must be given to a Zurich nation by all remaining governmental powers to fill the empty position. The new official will finish the remaining term on an interim status until the next elections take place. No person shall hold more than one elected-official position simultaneously.

3. The UN Delegate may only hold that single government position. In the event that a current government official becomes the new UN Delegate, he/she will have to resign to one of the two posts within a period of one week. Failure to do so results in an automatic impeachment from the non-UN Delegate position.

ARTICLE III - AMENDING THE CONSTITUTION

1. Any additions or subtractions to this Constitution requires the sponsorship of a government official. The proposed amendment must acquire a consensus vote from all governmental positions AND subsequently, a majority support by all voting, resident nations in Zurich.

2. Laws outside this Constitution may be created with the consensus vote of all government officials without the need for approval from the Zurich people as long as such laws don't violate any of the terms of this Constitution. No government official shall be entitled to endorse, pass, enact or enforce any law that creates a conflict with the provisions of this Constitution. Doing so, constitutes an Act of Treason against the sovereign Region of Zurich and results in the immediate dismissal of the government official(s) from his/her post(s).

ARTICLE IV - IMPEACHMENT OF GOVERNMENT OFFICIALS

1. Any nation of Zurich has the right to create a petition requesting the impeachment of an individual government official. Petitions must be stated on the main board and/or the official offsite forum. Zurich members may not sign the petition more than once no matter how many nations they possess. Petitions will last 1 week from the creation date. For the impeachment process to go forward, the petition must collect an equal or greater number of votes than the government official gathered during his/her election.

2. If the petition gathers enough votes, the UN Delegate (who is not subject to the impeachment process) shall be responsible for organizing the impeachment vote. Constitutional process for voting in elections shall be applied to the impeachment vote using a "yes or no" system. Should the impeachment be successful, the government official must step down immediately. The vacancy created shall be filled in accordance with Article II, number 2 of this Constitution.

3. A government official may only be subject to the impeachment process once per term served. Additionally, current government officials do not have the right to vote in the impeachment of a fellow official. Also excluded from voting during an impeachment process are nations that openly represent foreign regions or interests.

ARTICLE V - NATION RIGHTS

1. No law shall be enacted against a nation's establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, as long as it doesn't fall into the nationstates.net definition of spam.

2. The right of resident nations in Zurich to be secure in their territory, shielded from unreasonable searches and seizures, shall not be violated, and no nation shall receive the maximum penalty of ejection without an effective criminal verdict. A trial against a Zurich nation, may be started by another person citing probable cause or injury, and must be supported by oath or affirmation.

3. In all criminal prosecutions, the accused nation shall enjoy the right to a speedy and public trial. The defendant has the right to be informed of the nature and cause of the accusation; to be confronted with the witnesses supporting such accusation; and to have the assistance of other Zurich nations for its defense. Cruel and unusual punishment is forbidden.

NOTE: This Constitution has been ratified by a majority, popular vote composed of resident nations of Zurich (UN and non-UN).
