Magna Cartman Constitution

The constitution of Magna Cartman spells out the creation of the nation, it's government, defence and citizen rights.

Preamble

This document is to be known as the constitution of Magna Cartman and commences operation on the day the nation's first president is elected.

Sovereignty

1. The island presently known as "Magna Cartman Island" is to be referred to as "The Colony of Magna Cartman".
2. Magna Cartman is an independent nation and is not controlled by any other entity.
3. All citizens of the Magna Cartman Island automatically become citizens of The Colony of Magna Cartman.

Governance

4. The head of state is to be the president.
5. The president is to be elected by a 50% majority of voters.
6. All residents over the age of 18 must vote. If they fail to vote, the government may determine an appropriate fine.
7. The president shall take office one month from the day of the election.
8. If a dispute arises in the election process, the person whom wishes to lodge such dispute must do so within 4 days of the election at their local court house.
9. The president remains in office until they resign or die.
10. The national government is comprised of the president and no other. The president of Magna Cartman is responsible for enacting all laws related to the nation.

11. The leader of a region or city is to be the mayor.
12. The mayor is placed in office by the president, and his decision is final.
13. The mayor remains in office until they resign or die.
14. The regional/city council is comprised of a mayor and no other.
15. The regional/city council is responsible for enacting all laws related to their region.
16. The regional/city council is responsible for the provision of police, hospital and education services unless the mayor nominates for these to be handled by the national government.
17. If a law enacted by a mayor conflicts with a national law, then the national law shall prevail.

18. If the president shall die whist in office, the longest serving mayor shall become the administrator of the nation until such time as a new president is inducted.

Military

19. The president my convene a military that may comprise of numerous departments and agencies.
20. The purpose of the military will be to protect the nation from both internal and external forces.
21. Martial law may be declared by the president as they see fit. 22. The military shall have an "chief of the military" who is responsible to the president.
23. Each military agency will have a chief who is responsible to the chief of the military.
24. All men aged 15 to 24 shall serve in the military.

Rights

25. Each citizen of Magna Cartman shall have access to health care and education.
26. Citizens of Magna Cartman have the right to peaceful protest, except under martial law conditions.
27. Citizens shall have access to fair judicial procedure.
28. Citizens shall not be detained by the government unless there is reasonable grounds for doing so.

Modifications

29. The constitution may only be changed be referrendum. The referrendum must be labeled "Constitutional referrendum".
30. For a referrendum to pass it must:
a) receive a 50% vote in each region/city that is headed by a mayor AND
b) receive at least 60% overall.
