The Constitution of Northern Delon

This is the starting point of the new nation.

Article 1: Division of Powers

In the nation of Northern Delon, the government is to have three branches. The branches are to be independant of one another. The branches will have their own tasks, and will do those tasks, and only those tasks. The branches are to be the Governor's Branch, the Legislatorial Branch, and the Judiciary branch.

Article 1a: The Legislatorial Branch

The Legislatorial branch will consist of three representatives from each county. The largest three counties will have one extra representative for every three million people that they have more than the fourth largest county. If they do not have three million people more than the fourth largest county, they are to have one representative. The maximum number of extra representatives per county is three. Representatives are to be elected every three years.

Laws are to be introduced through this branch. A citizen of a county may send a proposal to any of its county's representatives. That representative will introduce the proposal to the Branch at the next meeting. The Branch will then vote on whether the proposal should be made a law. If the majority votes for the proposal, it will go to the Governor for approval. If he does not approve, the bill must go back to the Branch, where three quarters must vote for it. If it passes again, it will not be passed to the Governor. If it is not a law reguarding civil or political freedoms of individual citizens, it will become law in one month. If it is a law reguarding said freedoms, it will go to popular vote, where one half of citizens in the nation must vote in favor for it to pass. A Representative may only serve for eight years.

Article 1b: The Judiciary Branch

The Judiciary Branch will consist of seven judges. These judges will have the authority to overrule any dicision the Legislatorial Branch makes if they rule it unconstitutional. The seven judges are to be elected by popular vote every three years. A judge must have previous experience in law as both a judge and as a lawyer. This branch will also handle lawsuits against the State. In the event that a petition for a law to be overturned fails, it may continue to be petitioned as long as nececcary. A judge may serve for as long as he or she is elected.

Article 1c: The Governor's Branch

The Governor's branch will handle all other aspects of government not specifically handed to the other two branches. The Governor will have the executive decision over what happens in the Governor's branch. A Governor may be taken out of office if he or she commits a crime, and is ruled by the Judiciary branch to be unfit for governing. If a citizen petitions the government for the Governor to stay in office, and the petition is signed by at least one thousand other people, the dicision will be put up to popular vote. The Governor's Branch may not deny a citizen his or her rights. A Governor may be in office for no more than eight years. + The Governor's branch will handle all other aspects of government not specifically handed to the other two branches. Article 2: Elections

Elections are to be had on the seventh day of June every year. Every citizen is alowed to vote fro whomever they want. The government may not ask a citizen for whom they voted, nor may they watch the citizen vote. The government is never allowed to know for whom a specific citizen voted.

There is to be at least one area in every county where citizens can vote. There are to be no more than three government paid people for every one thousand voters. None of these people is allowed to carry a weapon while within the area, nor attempt to intimidate a voter.

Voting machines must allow the voter privacy while voting. They must provide a clear, easy and accurate way of voting. Paper documentation must be made by the machine to trace votes. In the event that a computerized machine is used, its codes must be approved by all the Judiciary Branch, the Governor, the Chairman of the county in which it is being used, and seventy five percent of the Legislatorial Branch.

Article 3: Rights of a Citizen

All citizens of all ethnicities, sexes, shapes, and sides are to have equal rights under the law. While immigrants are in the nation, they too are to have equal rights as the citizens.

All citizens have the right to do whatever they wish to their body. If they wish, they may have another adult perform acts on them, including, but not limited to: euthinasia, abortion, surgery, sexual acts, and medication. Both parties must agree to these actions. Abortions may only be performed durring the first four months of pregnancy. Euthinasia may only be performed if the person to be euthinised consents, and is seriously ill or injured.

All citizens have the right to say, write, and believe whatever they want, except when it clearly violates the rights of other citizens. If someone is to purposefully say something that directly causes a crime, they are guilty of being an accessory to that crime. Laws may nevr be passed to infringe this right.

Citizens also have the right not to beleive in something, as well as the right not to say something. These rights include those who are in custody of the State. Under no circumstances will a criminal be forced to say anything. Every person who is arrested has the right to have a lawyer present during questioning. However, if the accused decides to waive this right, he or she may do so. Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Citizens may also peacefuly assemble at any time, in any area, public or private. If an area requires security clearence, or is owned by someone other than a member of the assembly, the group may be denied access.

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed. However, no soldier shall be quartered in any house without the consent of the owner. Also, Soldiers are absolutely never allowed to arrest a person. The only case in which a soldier is allowed to harm another person, is in cases of self defense, where the other person is carrying a weapon, or is reaching for one.

The right of the people to be secure in their persons, houses, papers, electronic storage, and effects, against unreasonable searches and seizures, shall not be violated, and all warrants must have probable cause, supported by oath or affirmation, and must particularly describing the place to be searched, and the persons or things to be seized. However, if in the search of items described on the warrant, other items are found that link the person to a crime beyond reasonable doubt, the person may be arrested and charged for those crimes.

Article 4: Ammendment of the Constitution

Should it be decided that the Constitution is not clear enough on an issue, or that it is wrong about an issue, it may be fixed through an amendment. All amendment proposals are to pass through the Representative Branch as a law, and then go to popular vote. Four fifths of the population must vote in favor of the amendment for it to pass.

Article 5: Prosecution and Arrest of Criminals

Northern Delon is to have one police agency, to be known as the State Police. This organization will be the only Federal organization allowed to arrest suspects. It is only allowed to arrest suspects of Federal crimes. Every suspect must be notified at the time of arrest what they are being arrested for, and that they have the right not to incriminate themself. After being arrested, a suspect will be handed over to the Department of Corrections, where they will be held until trial.

All offenders are innocent until proven guilty by a jury of their piers. All people have a right to a fair and speedy trial. These trials will be moderated by one judge, to be hired by the court. The verdict is to be decided by a jury of ten citizens. These citizens may not show any prejudice against or for the defendant. If necessary, the trial will be moved to a new venue. For a Guilty verdict, half of the jury must decide that the defendant is guilty beyond a reasonable doubt. If more than half think that the defendant is not guilty, then he will be allowed to go free. Courts are to be organized by individual cities and towns.

Article 5a: Local Police Forces

All counties, towns, cities, and villages within the boarders are allowed to have their own police force. These police forces are to arrest criminals within their jurisdiction, as long as it does not interfere with the State Police.
