Constitution

The Constitution of Sumer Enacted: Year 10,004 (2005 CE)

Preamble

We, the parents, children, and citizens of Sumer, bound together by history, by blood, and by faith, with the interests of peace and harmony among our lands in mind, do herby approve and recognise this document as the Constitution of the Dictorial Republic of Sumer.

Chapter I: The Dictorial Republic of Sumer

Article I: Constitutional Amendments

(1) With the exception of Chapter I, this Constitution may be amended by the will of the Citizens of Sumer, following a fair and just referendum, with a result in favour of the proposed amendment of seventy-five percent (75%) or greater.

(2) Chapter I of this Constitution may not, in any way, be altered by legislative process, or by the People or Government of Sumer.

Article II: National Identity

(1) The Dictorial Republic of Sumer shall be the official title, equivalent with the titles of “Sumer” and the “Republic of Sumer”.

(2) Sumerian is the Official Language.

(3) The Sumerian religion, as practised by authorized Priests in licensed Temples, is the Official state recognised religion.

Article III: Government Authority

(1) Government Authority shall be held by an appointed Dictator, and bound to this Constitution under punishment of National law.

(2) The Civil Senate shall be the representation of the people, for the people, to the government of Sumer.

(3) The Civil Senate, following a vote of eighty percent (80%) in favour, and a referendum of the people with an eighty percent (80%) in favour vote, may counteract the wishes of the Dictator, and/or install a new Dictator by popular vote or force.

(4) Government office may be held only by a citizen who has held a rank as Officer in the Armed Forces of Sumer, and is restricted to a wage equivalent to one-hundred and twenty thousand dollars ($120,000 USD) per year of service, and a pension equalling half pay for so long as the Government Official remains alive.

(5) The Dictator remains in authority for life, unless otherwise removed by force, the Civil Senate, or abdication. Civil Senators remain in Office for a period of no more then four (4) years.

Article IV: The State

(1) The sovereignty and territory of Sumer is an indivisible entity, of which no part may separate.

(2) The objective of the Dictorial Republic of Sumer is the continuation of the principals of its ancestors, and the realization of a peaceful, stable state for its citizens.

(3) The National Flag, Emblem, and all stipulations concerning the two are governed by National law.

(4) Uruk is the capital city of Sumer, and can be transferred by law.

(5) The Dictorial Republic of Sumer is divided into self-administrated Regions, and Municipalities, each self autonomous within the confines of National law.

(6) All Regions of Sumer shall be considered equal, and share an equal number of seats in the civil Senate.

Article V: Nationality and Citizenship

(1) Citizenship of the Dictorial Republic of Sumer shall be regulated by National law.

(2) Citizenship of the Dictorial Republic of Sumer may only be obtained by those practitioners of the State recognised religion.

(3) Citizenship of the Dictorial Republic of Sumer carries with it the privilege of voting in elections for the Civil Senate, and of running for those elections, no other benefits may be bestowed upon a Citizen.

(4) All people of Sumer who do not meet the requirement for Citizenship may be Legal Residents, carrying all rights and freedoms guaranteed to them by National Law, and bound by all such responsibilities.

(5) This Constitution recognises the rights and freedoms of all people, regardless of age, race, religion, or political affiliation.


Chapter II: Social and Economic Foundations

Article VI: Social Solidarity and Society

(1) The social solidarity is the first foundation for the Society. Its essence is that every citizen accomplishes his duty in full, and that the Society guarantees the citizen's rights and liberties in full.

(2) The Family is the nucleus of the Society. The State secures the safety and security of the Family, and ensures child care is undertaken by the parents.

(3) The State assumes full responsibility for economic planning and control for the purpose of maintaining economic stability.

(4) The State encourages public cooperation among Citizens and Legal Residents in all affairs, and secures this right to do so.


Article VII: Property Rights

(1) Natural Resources and Industrial Production capabilities are property of the State, as outlined in National law.

(2) Ownership is a social function, to be exercised within the objectives of the Society and the plans of the State, according to stipulations of National law.

(3) The privilege of Private Ownership of Property, and of Economic Liberty are guaranteed to all Citizens and Legal Residents of Sumer in compliance with this Constitution and National Law and Economic Planning.

(4) Private Property may be expropriated by the State, in accordance with this Constitution and National law.

(5) Inheritance is guaranteed as a privilege to all Citizens and Legal Residents of Sumer, as outlined by National law.

(6) Property Rights inside of Sumer of individuals who are not Citizens or Legal Residents of Sumer are not recognised by the State or People.


Chapter III: Rights and Responsibilities of the People

Article VIII: Equality Before the State

(1) All Citizens and Legal Residents are equal before the law, regardless of race, religion, gender, language, social origin, or nationality.

(2) Children under the age of twelve (12) are the responsibility of their parents, and are bound to the law of their parents in accordance with National law.

Article IX: Criminal Law and Penalty

(1) An accused is presumed innocent until proven guilty at a legal trial.

(2) The right of defensive counsel is sacred to the accused, and can not be removed throughout all stages of the trial process.

(3) Courts Sessions are public, unless declared secret by the court, or requested by the accused or defence counsel.

(4) There can be no crime, nor punishment, except in conformity with the law. No penalty shall be imposed, except for acts punishable by the law, while they are committed. A severer penalty than that prescribed by the law, when the act was committed, cannot be inflicted.

Article X: Privacy and Personal Dignity

(1) The dignity of all People is safeguarded. It is inadmissible to cause any physical or psychological harm.

(2) No person may be arrested, stopped, or searched, except in accordance with National law.

(3) The private home of any Citizen or Legal Resident may not be searched, or entered without the express permission of the owner of the property, or within the limits of National law.

(4) The secrecy of communication through mail, electronic mail, telegrams, and telephone, is guaranteed, except in cases of Security or Criminal Trial, in accordance with National law.

(5) Citizens and Legal Residents alike can not have their right to freely enter and leave the State Territory as defined by National Law, except in cases of Security or Criminal Trial, as defined by National Law.

Article XI: Freedoms of Expression and Political Affiliation

(1) All Citizens and Legal Residents have the right to freedom of thought, expression, assembly, opinion, publication, and formation of societies and syndicates in accordance with this Constitution and National law.

(2) Freedom of religion is a right guaranteed to all Legal Residents of Sumer, in accordance with this Constitution and National law.

(3) State Public Education shall endorse only those beliefs acknowledged by Scientific research within the international community proven as fact, allowing no endorsement of religion outside of the State recognised religion, and insuring that all Citizens and Legal Residents learn the basics of accepted Science as academic over religion.

(4) Citizens and Legal Residents of Sumer are provided the right to modern comforts and enjoyments, and encouraged to progress to best of their ability in such areas.

(5) The right to asylum is guaranteed to those individuals who are in accordance with National law.

(6) The State guarantees that no entity, Internal or External, shall remove this right from the People.

Article XII: Education and Health

(1) The State undertakes the struggle against illiteracy and guarantees the right of education, free of charge, in its primary, secondary, and university stages, for all Citizens and Legal Residents.

(2) The State strives to make the primary education compulsory, to expand vocational and technical education in cities and rural areas, and to encourage particularly night education which enables the popular masses to combine science and work.

(3) The State guarantees the freedom of scientific research, encourages and rewards excellence and initiative in all mental, scientific, and artistic activities and all aspects of popular excellence.

(4) The State assumes the responsibility to safeguard the public health by continually expanding free medical services, in protection, treatment, and medicine, within the scope of cities and rural areas.

Article XIII: Service and Duty

(1) Service in the Armed Forces is an honour, and the security of the State is the sacred duty of all Citizens and Legal Residents alike. Military Service is voluntary, conscription may be enacted in accordance with National law in times of emergency.

(2) The Armed Forces belong to the People, and represent the People on the international scene. The Armed Forces are responsible for the defence of the State, the People, and the sovereign territory on which the People reside, as well as the interests of the Nation as a whole in the international community.

(3) The State alone establishes the Armed Forces. No other organization or group, is entitled to establish military or Para-military formations.

(4) Work is a right, which is ensured to be available for every able citizen.

(5) Work is an honour and a sacred duty for every able citizen, and is indispensable by the necessity to participate in building the society, protecting it, and realizing its evolution and prosperity.

(6) The State undertakes to improve the conditions of work, and raise the standard of living, experience, and culture for all working citizens.

(7) The State undertakes to provide the largest scale of social securities for all citizens, in cases of sickness, disability, unemployment, or aging.

(8) The State undertakes to elaborate the plan to secure the means necessary, to enable the working citizens to pass their vacations in an atmosphere, which enables them to improve their health standard, and to promote their cultural and artistic talents.

(9) Payment of taxes is the duty of every citizen. Taxes cannot be imposed, nor modified, nor levied, except by a law.


Chapter IV: Government Institutions

Section I: Government Headquarters

Article IXX: Higher Authority

(1) The Office of the Government Headquarters is the highest legal authority of the State. The Office of Dictator is in command of, and represented by, the Government Headquarters.

(2) Orders from the Government Headquarters may be contradicted by the Civil Senate and a referendum of the People, in accordance with this Constitution and the National law.

Article XX: Acquisition of Office

(1) An Office of authority within the Government Headquarters may only be acquired by appointment by the Dictator in power, and is held until relieved of command and retired.

(2) Office in the Government Headquarters may only be held by a Citizen and Officer in the Armed Forces of Sumer.

(3) The office of Dictator may only be acquired by appointment of the Civil Senate following a vote of eighty-five percent (85%) in favour of the candidate, or by peaceful or forceful military takeover whereas no innocent civilian lives are endangered.

Article XXI: Responsibilities

(1) The Office of Government Headquarters is responsible for all International relations, National laws, the enforcement of laws, and all Nationalized agencies within the State as outlined by National law and this Constitution.

(2) Government Headquarters shall make no motion to hinder the progress of the People, or that of Scientific research within the State, under penalty of National law, and bound by this Constitution.

(3) It is the Responsibility of the Government Headquarters to seek and accept the advice of the Civil Senate under penalty of National law.

Section II: The Civil Senate

Article XXII: Representation of the People

(1) The Civil Senate is to be elected by Citizens of Sumer, for the People of Sumer, to represent the interests and beliefs of the people as a whole to the Government Headquarters.

(2) The Civil Senate is to comprise of, and be elected by, Citizens of Sumer, but are bound by this Constitution and National law to represent both Citizens and Legal Residents alike.

Article XXIII: Responsibilities of the Civil Senate

(1) The Civil Senate is Responsible for conveying the wishes, dreams, desires, and ideas of the People to the Government Headquarters, and ultimately the Dictator.

(2) The Civil Senate is responsible only to the People, and may not be coerced by any other Governmental form, both internal and external, under penalty of punishment as situated by National law.
