NEW WESTMOORE BACKGROUND

New Westmoore was created on March 16, 2007, from disgruntled nations of the original Westmoore region. All nations are welcome to New Westmoore but can lose that welcome if any of the rules are broken. The region is democratic, to a point; and follows free speech and expression ideals - the inclusion of the word "ideals" means the rules are not the same as those in the Bill of Rights.

The Westmoore Merger

An official merge between the two Westmoores began on April 10, 2007. All remaining active nations from Westmoore made the journey to New Westmoore soon after. New Westmoore hopes the merge will boost involvement and spirit; it hopes the new nations can help it grow in power.

GOVERNMENT

The New Westmoore Constitution

All member nations and visiting nations are protected by the Constitution but are also expected to conform to its rules. Each article will be posted upon its passing.

Preamble

We the sovereign nations of New Westmoore, in order to create an efficient and long-lasting region, establish a safe haven for all, insure regional tranquility and equality, provide for those who seek opportunity, promote nations’ involvements in the region, and secure the benefits of having a clearly-defined and written shield to protect all nations, do ordain and establish this Constitution for the Region of New Westmoore.

Article I- Concerning Member Nations in General

1. All nations of any United Nations(UN) category from any region has the right to join the region of New Westmoore. Although, every nation can lose the right to stay by a vote of the member nations.
i) The process to eject a member nation from the region is contained in Article Three, Clause Two, Subclause i.
2. Every nation must create a hospitable environment for all nations by not using foul language in the message board, not making accusations or insults, and obeying the orders of the delegate or the founder of the region.
3. Upon entering the region, all nations must endorse the UN delegate within one week of their arrival. Failure to do so will result in warning and then ejection from the region. No endorsements may be made to any other nations except for the UN delegate. Each nation will receive two endorsements from two different nations.
i) The two nations that shall endorse the members of the region will be the regional delegate and the founder.
4. The failure to comply with any of these rules will result in a caucus of the Security Council, which could turn out a petition for the removal of the non-complying nation that would then proceed to be signed, or supported, by member nations, resulting in the ejection of non-complying nation.

Article II- Concerning the Position of United Nations Delegate

1. As defined by nationstates.net, the regional UN delegate is the nation in a region who has obtained the most endorsements from the other UN member nations in his region. The delegate has the ability to update the World Factbook for the region, vote for proposals in the United Nations, and possesses the power to access regional control(eject nations, etc.).
2. In accordance with Article I, Clause 3, of this constitution, every UN member nation of the region must endorse the current regional delegate within one week of entrance into the region.
3. The position of regional delegate is secure by endorsement process, but this does not allow the delegate infinite reign. Members must bring up grievances up by way of the regional message board, the regional forum, or a telegram to the founder.
i) In the event that the region must choose a new regional delegate, the founder will collect a vote from the General Assembly of the region to determine the new UN delegate by a majority vote.

Article III- Concerning the Regional Senate

1. The regional Senate will consist of regional representatives, senators, and the regional delegate. The delegate is the Head of the Senate and is required to report honorably the Senate's decisions to the Supreme Court and any other body that its decisions affect.
i) There is a single senator for every six (6) nations in the region; there is a single representative for every three (3) nations in the region. No member of the Senate may occupy another officially appointed or elected position.
ii) The position of Senator is a generally permanent position; once a senator takes office, only the regional delegate can remove him from power. The position of Representative is a rotating spot; the term for a representative is three (3) months in longevity.
iii) To elect a representative or senator, upon availability or term expiration, every member of the General Assembly of New Westmoore may send a telegram to the regional Head of the Senate with a list of two (2) nominees for the position of Representative (the Nomination Telegram System). The Head of the Senate will count the number of nominations for each nation, and the nations with the highest numbers of nominations will fill the available position. All positions must fill by number of nominations in descending order beginning with the nation with the most nominations. After three (3) days of voting, the regional delegate will reveal the elected officials on the regional forum and the regional Wiki page.
iv) In the event that the number of nominees for the representative position is less than the number of positions available, the founder will appoint willing nations.
2. The Senate has the power to vote upon proposals including, but not limited to, the appointment of Supreme Court justices, amendments to the Constitution of the Region of New Westmoore, ejection suggestion, and the removal from office of all position-holders.
i) To eject a member nation from the region, the Senate first must vote on the subject. If a majority vote returns to the Head of the Senate in favor of ejection, the matter goes to the Supreme Court of the region, where a two-thirds majority vote must return in favor of ejection to expel the nation from the region.
ii) To amend the Constitution of New Westmoore, the proposal must first pass with a two-thirds majority vote by the regional Senate. Then the matter is sent to the General Assembly of the region, where a majority vote must be given in favor of amendment to amend this constitution.
3. In the event that the Region shall be unable to obtain a fully differentiated Senate and Judiciary as prescribed & duly stipulated in this document, an Ad Hoc Acting Judiciary will be formed. Exactly three (3) Acting Justices shall serve on the Ad Hoc Acting Judiciary's bench. Two (2) Acting Justices shall be Senate members, and shall be nominated and elected by that body. The third Acting Justice shall be the Founder. The Ad Hoc Acting Judiciary shall take cases, find and rule exactly as prescribed in this Document. When the Region is determined to be able to accommodate a fully differentiated Senate and Judiciary as prescribed & duly stipulated by this document, the Judiciary shall be elected in the manner prescribed by this Document, and, once the Judiciary is elected and installed, the Ad Hoc Acting Judiciary shall be immediately dissolved.

Article IV- Concerning the Supreme Court

1. The Supreme Court is the judicial body of the region. The Senate elects its seven (7) justices, and only the same body may impeach them.
i) Any Member of the General Assembly of New Westmoore who wishes to become a Supreme Court Justice must send a Letter of Intent via telegram to the Founder, who shall in turn nominate, at his discretion and from those Members of the General Assembly who have expressed their Intent, a Candidate for Supreme Court Justice. That Candidate shall come before the Regional Senate, where he shall be administered an oath, and subjected to the scrutiny and questioning of that body until such time as all members of that body, including the Head of the Senate, have gathered enough testimony to vote on the candidate's Confirmation. Shall the Candidate obtain a majority of 'yea' votes in the Senate, he shall be administered an oath of office by that body, and shall be installed as a Supreme Court Justice.
ii) Only a two-thirds majority telegram vote to the Head of the Senate may impeach a justice of the Court. Any official member of the Senate may call the vote.
2. The duties of the Supreme Court are to vote upon the ejection of members of the region at the suggestion of the Senate, to reform the voting process if it is required, and to decide upon the constitutionality of the actions of the delegate and founder.
i) An official complaint from any member of the General Assembly other than the justices is required to bring voting reform or constitutionality into discussion.
3. All justices are equal in the Supreme Court and any member can call a meeting to discuss an official topic. All justices' votes count once and once only.
4. The founder must satisfy fully and honorably the decisions of the Supreme Court.

Article V- Concerning the Position of Founder

1. As defined by nationstates.net, the founder of a region is the nation who created that

region. The founder can access the “regional control” page which gives him the power to update the World Factbook Entry, password-protect the region (making it invitation-only), and eject trouble-makers.

2. As stated by Article IV, Clause Four of this constitution, the founder also has the duty

executing the will of the Supreme Court.

3. As stated by Article II, Clause Three, subclause i of this constitution, it is also the duty of

founder to collect votes in the event that elections for a new regional delegate are held.

4. While it is the duty of the founder to execute the will of the Supreme Court, he may,

under no circumstance, execute the powers that he maintains without the jurisdiction of the Supreme Court.

Article VI- Concerning Lawmaking and Upkeep of the Region of New Westmoore

1. Although this Constitution sets forth ground rules upon which the future of the region shall be placed, both the General Assembly and the Senate of New Westmoore may submit proposals for laws to aid in the general upkeep of the region.
2. A proposal shall be submitted to the Head of the Senate (the regional delegate) by way of a telegram, and the Head of Senate will proceed to present the issue to the Senate and collect votes on the matter.
i) A two-thirds majority vote of the Senate will be required to pass any new proposal into law.
ii) If any member of the General Assembly of the region requests that a certain law be repealed, then the Supreme Court shall review the matter. Should majority of the Supreme Court find fault in the law, the Court would pass the matter on to the Senate, who would call a vote to repeal the stated law. A three-fourths majority vote will be required to repeal any law previously passed by the Senate.
iii) Any member of the General Assembly may also propose an amendment to the Constitution. A three-fourths vote by the General Assembly is required to amend any article of the Constitution.
3. As previously stated in Article I, Clause Four, this Constitution shall be made law, and, therefore, binding. Any failure to comply with these laws so set forth will be subject to a review by the Supreme Court.
4. In accordance with the opportunity created by freedom, and the liberty created by democracy, this Constitution shall be rendered null and void if the majority of the region finds to be in need of a better governing document, binding law, or greater fairness in general.


Amendment I- Concerning Article III, Section 1

i) There is a single senator for every ten (10) nations in the region; there is a single representative for every five (5) nations in the region. No member may occupy more than one (1) position holding voting power.

Amendment II- Concerning Article III

REPEALED 3. Until such time that the region of New Westmoore becomes more vast in the number of active nations, the regional Senate will wield primary law-making authority in the region (which it already maintains), and would hold the power of the future Supreme Court. After the region expands into a more momentous state (that is to say, there are enough nations controlled by different members active in the region to form a Supreme Court while still holding the Senate and, at least, a five nation general assembly) and a proper Supreme Court can be assembled, the Senate will concede its power unto the three-branched government as a whole. REPEALED

Amendment III- Concerning Amendment II

Amendment III hereby repeals and declares void Amendment II.

Amendment IV- Concerning Article III, Section 3

3. In the event that the Region shall be unable to obtain a fully differentiated Senate and Judiciary as prescribed & duly stipulated in this document, an Ad Hoc Acting Judiciary will be formed. Exactly three (3) Acting Justices shall serve on the Ad Hoc Acting Judiciary's bench. Two (2) Acting Justices shall be Senate members, and shall be nominated and elected by that body. Senate

The Senate is New Westmoore's legislative body. It is chaired by the UN Delegate and strictly follows the voting system outlined by the Constitution of New Westmoore. Senate membership is open to all members; to attain membership, a nation must be nominated and elected by the General Assembly. The limit on the number of senators and representatives is dictated by the Constitution.

The Senate is currently in hibernation.

Supreme Court

The Supreme Court is the judicial body of New Westmoore. All of the judges have a single vote and there is no chair. Supreme Court seats are available to all members who are nominated and elected by the Senate, excluding senators.

The Supreme Court is currently a low priority of the region. Upon creation, the Senate will elect judges.

The General Assembly

Each nation in the General Assembly receives one vote. The issues they vote upon affect the entire region and are defined more clearly by the Constitution.
