Introduction to Vuken

Vuken (officially the Democratic Republic of Vuken) is a democracy ruled by its people. It was formed on 25th January 2007 from a seperatist movement of the Republic of Uogen which is a dictatorship. . The nation been quite new has very little history yet. The constitution was signed on the 27th January 2007.

Section 1. Fundamental Principles

Article 1.

The Democratic Republic of Vuken is one independent and fully sovereign state in which the system of government is republican representative democracy.

Article 2.

A) The Democratic Republic of Vuken is a Secular state. No religious body shall have control of any branch of the Democratic Republic of Vuken’s government on the virtue of being a religious body. B) The right to practice one’s religion except when practicing it is a breach of the laws of the Democratic Republic of Vuken and the right to hold any belief is guaranteed.

Article 3.

The official language of the Democratic Republic of Vuken is English as such all formal documents shall be written in it and all facilities of education shall teach it.

Article 4.

A) The security services, intelligence services and the armed forces personnel may not stand for election to any office in any branch of government. B) Compulsory national service or conscription in any way shape or form is forbidden. C) All security and intelligence services shall operate under civilian control and be subject to oversight from all branches of government. It shall operate in accordance to law and the recognized principles of human rights.

Article 5.

Waquies is the Capital City of the Democratic Republic of Vuken.

Article 6.

This constitution is the supreme law in the Democratic Republic of Vuken and shall be binding in all parts of the Democratic Republic of Vuken without exception. No law shall be enacted that contradicts this constitution. No amendments to this constitution are permitted.

Section 2. The Bill of Rights

Article 7.

All citizens are equal before the law without discrimination based on gender, race, ethnicity, origin, colour, religion, beliefs, economic and social status.

Article 8.

Every individual citizen or non citizen has the right to enjoy life. Deprivation of this right is a breach of law and restricted. Every citizen unless it is restricted by legal proceedings or a court of law shall have the right to liberty.

Article 9.

All born within the borders of the Democratic Republic of Vuken or to a father or mother who is a citizen of the Democratic Republic of Vuken are considered citizens of the Democratic Republic of Vuken. This citizenship may not be revoked except at their own free will or if they spend over ten years abroad.

Article 10.

All citizens over or at the age of 16 and on the electoral register may vote in elections for the legislative branch of government. Citizens over or at the age of 18 may also stand for election to these branches if they meet electoral qualifications laid down by law.

Article 11.

In a court of law an accused is presumed innocent until proven beyond all reasonable doubt to be guilty. An accused may not be tried for a second time unless new evidence emerges or the proceedings are proven to be biased.

Article 12.

No punishment shall be handed out for a breach of law more severe than that than the maximum applicable sentence at the time. The punishment shall be personal.

Article 13.

The right to a defence shall be guaranteed at all stages of legal proceedings. If an accused cannot afford a lawyer, a trained legal professional shall be nominated for the purposes of providing the accused a defence. The accused may elect to represent him/her self in court.

Article 14.

Unlawful detention shall be restricted.

Article 15.

No citizen of the Democratic Republic of Vuken shall be surrendered to foreign authorities without the consent of a court of law.

Article 16.

No political refugee shall be surrendered to a foreign authority or returned forcibly to the country from which he/she fled.



Section 3. The Legislative Branch of Government

Article 17.

The legislative branch of government shall be the Legislative Assembly. The role of the Legislative Assembly is to pass laws and to hold the Executive Branch of Government to account.

Article 18.

The Legislative Assembly shall consist of a Chamber of Representatives and a Senate.

Article 19.

The Democratic Republic of Vuken is to be divided in 200 seats. Each seat shall have roughly equal population. Each seat shall have one representative elected by citizens registered to vote in that seat. Citizens may only be on the electoral register in one seat and they must live in that seat. Citizens must be over the age of 16 or of the age of16 to vote. The elected representatives sit in the Chamber of Representatives.

Article 20.

All bills shall originate in the Chamber of Representatives and must get atleast 50% approval (or more) before proceeding to the Senate. Finance Bills shall only require the approval of the Chamber of Representatives to be committed to law. All members of the Council of Ministers whatever house of the Legislative Assembly they sit in are questioned weekly in the Chamber of Representatives. 5 or more members of the Chamber of Representatives may form committees which may examine anyone.

Article 21.

The Chamber of Representative shall be elected atleast every two years.

Article 22.

Only parties may run for the Senate. Independent candidates are barred. The Senate shall consist of 100 seats. Each citizen on any electoral register shall have 100 votes. They will then award votes proportionally to party based on how many seats they wish parties to have. The parties then get a percentage of the seats each based on percentage of votes. The parties then via internal systems appoint Senators to seats the party is given.

Article 23.

The Senate has to approve all declarations of war and peace made by the executive branch by atleast a 60% approval. Before bills become acts they must receive atleast 50% approval of the Senate. Treaties as well as receiving required approval by officials in the executive branch must receive atleast 50% approval from the Senate. Executive Orders have to receive 66% approval. If executive orders receive this they are then law.

Article 24.

The Senate shall be elected every 4 years.

Section 4. The Executive Branch of Government

Article 25.

The Executive branch of government shall consist of a President of the Democratic Republic of Vuken and a Council of Ministers.

Article 26.

To be President of the Democratic Republic of Vuken one must meet the following requirements:

A) To be a citizen by birth. B) To have not been convicted of a crime C) To not be an office holder of a Legislative Branch or Judicial Branch government office.

Article 27.

The President of the Democratic Republic of Vuken shall be elected by the Legislative Assembly every 6 years. The candidate with the most votes wins. The Senate must then approve the decision. If the Senate rejects the decision a new candidate must be elected.

Article 28.

The President of the Democratic Republic of Vuken shall have the following functions: A) To appoint and dismiss the Chancellor of the Democratic Republic of Vuken from the Chamber of Representatives. B) To serve as Chief Executive Officer and serve as Commander in Chief of the armed forces. C) If a bill has passed both houses of the Legislative Assembly it shall be presented to the President of the Democratic Republic of Vuken. D) To appoint the Vice President of the Democratic Republic of Vuken. E) To grant executive pardons. F) To appoint Supreme Court Judges. Once appointed they sit for life unless they resign or 50% of the Senate vote to remove them.

Article 29.

When the President of the Democratic Republic of Vuken is unavailable his/her powers are delegated to the Vice President.

Article 30.

The Chancellor of the Democratic Republic of Vuken who shall be a representative selected by the President of the Democratic Republic of Vuken shall have the following functions: A) To appoint and dismiss the Council of Ministers from either house of the Legislative Assembly. B) To chair the Council of Ministers. C) To serve as Chief Adviser to the President of the Democratic Republic of Vuken. D) To make executive orders. E) To set government policy. F) To represent the executive to the Legislative.

Article 31.

The President of the Democratic Republic of Vuken may actively use his/her powers and may take or deny the advice of the Chancellor. The Chancellor of the Democratic Republic of Vuken may also actively use his/her powers as well and neither is purely ceremonial.

Article 32.

The Council of Ministers shall consist of Minister of Finance, a Minister of Justice, a Minister of Foreign Affairs, a Minister of Defence, a Minister of the Interior, a Minister of Culture, a Minister of Education, a Minister of Health and a Minister of the Environment.

Article 33.

The Minister of Finance shall be the only member of the Council of Ministers other than the Chancellor that must come from the Chamber of Representatives. The functions of this minister are: A) To write the government’s budget. This will detail which ministers get what money and how the money will be raised. 50% of the Chamber of Representatives must approve this. B) To handle all financial and economic executive matters. C) To serve as Deputy Chancellor of the Democratic Republic of Vuken. D) To serve as Financial Adviser to the President of the Democratic Republic of Vuken.

Article 34.

The Minister of Justice shall have the following functions: A) To appoint Circuit Judges. Once appointed they sit for 15 years unless they resign or 50% of the Senate vote to remove them. B) To administrate the Courts, the prisons and the criminal justice system. C) To represent the executive in Court. D) To serve as Legal and Justice Adviser to the President of the Democratic Republic of Vuken.

Article 35.

The Minister of Foreign Affairs shall have the following functions: A) To appoint and dismiss ambassadors to another nations on behalf of the President of the Democratic Republic of Vuken. B) To represent Vuken at all international organisations. C) To serve as Chief Diplomatic Officer on behalf of the President. D) To take ministerial responsibility for the Secret Intelligence Service.

Article 36.

The Minister of Defence shall have the following functions: A) To appoint and dismiss the Chief of the General Staff and the Adjutant General. B) To take military decisions on both strategical and administrative matters. C) To represent the Commander in Chief to the armed forces. D) To take ministerial responsibility for the Defence Intelligence Staff.

Article 37.

The Minister of the Interior shall have the following functions: A) To administrate the police and the immigration service. B) To take ministerial responsibility for citizenship and domestic security matters. C) To serve as Security Adviser to the President of the Democratic Republic of Vuken. D) To take ministerial responsibility for the security service/

Article 38.

The other ministers shall have the functions given to them by the Chancellor of the Democratic Republic of Vuken.

Section 5. The Intelligence Services and the Military

Article 39.

The Security Service shall be headed by a Director-General of the Security Service appointed and dismissed by the joint decision of the Minister of the Interior and the Director of Central Intelligence. It shall be responsible for domestic security.

Article 40.

The Secret Intelligence Service shall be headed by a Director-General of the Secret Intelligence Service appointed and dismissed by the joint decision of the Minister of Foreign Affairs and the Director of Central Intelligence. It shall be responsible for Foreign Intelligence.

Article 41.

The Defence Intelligence Staff shall be headed by a Chief of Defence Intelligence Staff appointed and dismissed by the joint decision of the Minister of Defence and the Director of Central Intelligence. It shall be responsible for Military Intelligence.

Article 42.

The Director of Central Intelligence shall be appointed and dismissed by the Chancellor of the Democratic Republic of Vuken. He/She is chair of the Joint Intelligence Committee and has all the rights of the heads of the three intelligence agencies in their agencies in all agencies.

Article 43.

The Joint Intelligence Committee consists of the Director of Central Intelligence (chair), Director-General of the Security Service, the Director-General of the Secret Intelligence Service, the Chief of Defence Intelligence Staff, the Minister of the Interior, the Minister of Foreign Affairs and the Minister of Defence. It may examine any aspect of any agency and overrule the heads of the agencies.

Article 44.

The Chief of the General Staff is professional head of the armed forces. He/She appoints commanders in theatres of war and chairs the General Staff.

Article 45.

The General Staff consist of the CGS, CIDS and the commanders of theatres of war. They advise the Minister of Defence.

Section 6. The Judicial Branch of Government

Article 46.

The Supreme Court is the highest court in the land. It may strike down a law if it contradicts this constitution.

Article 47.

The Supreme Court consists of 5 Supreme Judges. When a vacancy arises the President shall appoint a replacement. Once appointed they sit for life unless they resign or 50% of the Senate vote for removal. Atleast 3 out of 5Supreme Court judges must agree for a Supreme Court Ruling.

Article 48.

The Supreme Court may repeal any decision or judgement by any lower court.

Article 49.

The Democratic Republic of Vuken shall be divided into four circuits. North Vuken, South Vuken, East Vuken and West Vuken shall be these circuits.

Article 50.

Each circuit shall have ten circuit judges appointed by the Minister of Justice when a vacancy arises. They sit for 15 years unless they resign or 50% of the Senate vote for their removal.

Article 51.

The Civil Court deals with all cases that do not involve a criminal offence except appeals. There will be one civil court per circuit. The Minister of Justice shall decide which Circuit Judge hears that case (it must be a judge attached to that circuit).

Article 52.

The Criminal Court deal with cases involving a criminal offence except appeals. There will be one Criminal Court per circuit. The Minister of Justice decides which Circuit Judge hears a case (it must be a judge attached to that circuit).
